The New Age of Dispute Resolution: Digitization & Evolving Norms
Join the UNCITRAL Secretariat for “The New Age of Dispute Resolution: Digitization & Evolving Norms”, an event jointly organized with the New York International Arbitration Center, New York State Bar Association, and the American Society of International Law.
This event will be held as part of UNCITRAL’s project on the Stocktaking of Developments in Dispute Resolution in the Digital Economy (DRDE). As part of its stocktaking activities to seek inputs from different parts of the world, the UNCITRAL Secretariat is organising this discussion with practitioners and academics in New York on two respective issues: (1) the use of technology in arbitration; and (2) online mediation.
Program Description
NYIAC and the UNCITRAL Secretariat, together with NYSBA International Section and ASIL, present the New York Stocktaking of Dispute Resolution in the Digital Economy (DRDE).
The project was launched in 2021, conferring on the Secretariat the mandate to monitor the changing landscape of dispute resolution in the digital economy by compiling, analyzing and sharing relevant information with a view to laying the groundwork for possible work on updating UNCITRAL texts or developing new ones as necessary. The project gives particular attention to the disruptive aspects of digitalization in dispute resolution, especially those with respect to due process and fairness. But it also focuses on the enabling aspects of technology particularly as far as the impact on efficiency, including cost and duration, of procedures is concerned.
The first panel will be devoted to the use of technology in arbitration, discussing topics including case management, new forms of presentation of submission and evidence, electronic awards, interim measures on preservation of assets, and suggestions for possible UNCITRAL work.
The second panel will be devoted to online mediation, discussing topics including pros and cons of online mediation, conducting online mediation, flexibility, and suggestions for possible UNCITRAL work.
